John F. Post argues that physicalistic materialism is compatible with a number of views often deemed incompatible with it, such as the objectivity of values, the irreducibility of subjective experience, the power of the metaphor, the normativity of meaning, and even theism.

The doctrine of precedent, as it has evolved within the common law, has at its heart a form of reasoning—broadly speaking, alogic—according to which the decisions of earlier courts in particular cases somehow generalize to constrain the decisions of later courts facing different cases, while still allowing these later courts a degree of freedom in responding to fresh circumstances. Although the techniques for arguing on the basis of precedent are taught early on in law schools, mastered with relative ease, and (...) applied on a daily basis by legal practitioners, it has proved to be considerably more difficult to arrive at a theoretical understanding of the doctrine itself—a clear articulation of the underlying logic. Growth of the philosophy of management might result from the consideration of man's potential as viewed by two different men, an industrialist and a philosopher. James Finney Lincoln was president and board chairman of The Lincoln Electric Company for 37 years. During that time, and for 14 previous years when he was the firm's general manager, he developed a philosophy basic to a practice of business management that gained national and international attention. A comparison of both men's philosophies reveals the following: In each view man's potentiality was approached by the dynamic, on-going process of developing his latent abilities or powers. Both views stressed freedom as being critical to the development of man's latent abilities or powers. For Lincoln the individual must gain satisfaction from the recognition of developing his latent abilities. For Humboldt the individual must enjoy the 'freedom of developing himself.' Lincoln warned against custom as being a barrier to development since it places man in situations which are without variation, forcing him merely to follow precedent. In general anesthesia, a “cocktail” of drugs renders a patient unconscious, in what has been called a “controlled coma”. Various measures of patient awareness involve overt behavior, autonomic nervous system activity, processed EEG, and event‐related potentials. The incidence of intraoperative awareness is very low, but anecdotal reports suggest that patients might process surgical events unconsciously, leading to unconscious postoperative memories. Careful experimental studies show that priming effects, similar to those observed in implicit memory, can be spared even in the absence (...) of conscious recollection, an outcome which indicates that unconscious perception can occur even in clinically adequate general anesthesia. Deeper planes of amnesia, however, appear to abolish both explicit and implicit perception. (shrink)

The controversy over Greek pronunciation at Cambridge University in 1542, principally between university chancellor Stephen Gardiner and regius professor of Greek John Cheke, marked the emergence of not only the linguistic but also the political agenda of the mid-Tudor Cambridge humanists. This important group included future statesmen and political thinkers such as William Cecil, later Elizabeth's famous minister, Thomas Smith, author of De republica anglorum, and John Ponet, leading exponent of ‘resistance theory’. In the 1542 Greek controversy Cheke (...) and his allies advocated the restoration of an ancient pronunciation they saw as having been the medium of eloquence in the Athenian republic. Their concepts of language provide a template for their political concepts: both language and political structures are generated by the community, reflective of the community's particular character, susceptible to change and capable of improvement. Throughout their subsequent careers and especially in the reign of Edward VI, when their influence was at its height, these humanists fostered a ‘monarchical republican’ politics; it involved rhetorical persuasion as the main mode of political action, programmes of religious and economic reform, and popular consent as an important factor in the good governance of the commonwealth. IN THIS study I shall concentrate on three leading philosophical and theological thinkers of the thirteenth century: Thomas Aquinas, Henry of Ghent, and Godfrey of Fontaines. Of these, Thomas Aquinas is surely the best known. But I have selected these three because their discussions of nonexisting possibles are sufficiently different from one another to illustrate some of the major solutions proposed to this issue at that time.

In this essay, I try to advance the reception of Karol Wojtyła’s seminal essay “Subjectivity and the Irreducible in Man.” In particular I try to understand and to think through the distinction that he makes between the “personalist” and the “cosmological” image of man. I unpack Wojtyła’s concept of subjectivity, which underlies all that he says about the personalist image of man. I give particular attention to all that he says about the unity formed by the two images. I then (...) proceed to apply Wojtyła’s analysis to a certain cosmological challenge to a personalist understanding of man: it is the challenge that comes from looking at the immensity of the cosmos and at the infinitesimal smallness of man in it and of thinking that man is swallowed up in this immensity and obliterated in his importance. I argue that precisely the subjectivity of the person implies that there is in each person an “infinite abyss of existence” so that each person is in reality his or her own whole and is no mere part of the cosmic whole but is incommensurable with it. The material to follow challenges the conceptual uniqueness and contribution of the content of the field of marketing ethics. Based on a comprehensive inspection of the marketing ethics literature, this "review note" (an uncommon genre of academic manuscript – a briefly-presented review highlighting a specific point) concludes that, in terms of pragmatic behavioral guidance as well as conceptual content, marketing ethics has nothing new nor distinctive to offer. Though an initially unexpected conclusion, perhaps, explanation is provided for why marketing ethics' (...) absence of contribution is perfectly natural and appropriate. Evidence also is found to establish that the paper's contrarian-appearing position may not be extremist after all. (shrink)

The worldwide growth of franchising has been phenomenal during the past decade. At the same time there has been increased media attention to questionable business practices in franchising. Similar to some trade associations and professions, franchising has sought self-regulation by developing codes of conduct or ethics. This study examines the codes of ethics covering franchising activities in 21 countries. The results reveal that there is considerable variation in the activities/issues covered by the codes. Specifically, the codes cover most stages of (...) the franchising relationship, focus on a narrow set of stakeholders, are short on ethical guidance, and offer few enforcement provisions. The implications of these findings for international franchising and research are discussed. (shrink)

It is based on a thorough examination of his texts organized according to the philosophical order as he himself describes it rather than according to the theological order. -/- In the introduction and opening chapter, John F. Wippel examines Aquinas's view on the nature of metaphysics as a philosophical science and the relationship of its subject to divine being. Part (...) One is devoted to his metaphysical analysis of finite being. It considers his views on the problem of the One and the Many in the order of being, and includes his debt to Parmenides in formulating this problem and his application of analogy to finite being. Subsequent chapters are devoted to participation in being, the composition of essence and esse in finite beings, and his appeal to a kind of relative nonbeing in resolving the problem of the One and the Many. Part Two concentrates on Aquinas's views on the essential structure of finite being, and treats substance-accident composition and related issues, including, among others, the relationship between the soul and its powers and unicity of substantial form. It then considers his understanding of matter-form composition of corporeal beings and their individuation. Part Three explores Aquinas's philosophical discussion of divine being, his denial that God's existence is self-evident, and his presentation of arguments for the existence of God, first in earlier writings and then in the "Five Ways" of his Summa theologiae. A separate chapter is devoted to his views on quidditative and analogical knowledge of God. The concluding chapter revisits certain issues concerning finite being under the assumption that God's existence has now been established. -/- John F. Donahue The present special issue of the American Journal of Philology takes as its focus dining in the Roman world. It grew out of the APA/AIA Joint Panel on that subject, which was part of the annual meeting held in Philadelphia in 2002. The topic is both timely and engaging. Indeed, owing largely to (...) its perishability, its diversity, and the ease with which it can be manipulated for any number of social or political ends, food has proven to be an especially amenable topic for scholarly analysis of all sorts.The articles gathered in this special issue further illuminate the nature and function of this elemental yet highly complex social practice, offering a variety of approaches—historical, sociological, literary, cultural, and material—to food and dining in the Roman world.In the first article, "The Way We Used to Eat: Diet, Community, and History at Rome," Nicholas Purcell shows clearly that food and dining can be profitably approached from a cultural perspective. Here, Purcell explores Roman self-consciousness about nutrition and the way in which diet (and implicitly agriculture) were transformed into a narration of historical change. The process is evident in the "comestible historiography" of the elder Pliny, in which the simple foods associated with earlier Roman history provide insight into the ways in which the Romans thought about time and change by focusing on food. Especially influential in this type of approach was Varro and, before him, Dicaearchus. Thus for the Romans, food played a notable role in the relationship of the present to various pasts; in the process it becomes an important marker in helping us to map the intellectual and cultural history of the Republican period.Turning to Roman literature, John Wilkins, in "Land and Sea: Italy and the Mediterranean in the Roman Discourse of Dining," reminds us that Roman dining was linked both to the ideology of the early Imperial period and to the mythography of the agricultural base of Republican politics. The result is a body of texts that moralize against luxury and excess, however much this viewpoint may be at odds with actual Roman practice. In a refreshing departure from the Latin texts that typically treat these themes, the author points to the Greek writers of the second [End Page 325] century C.E., namely, Athenaeus and Galen. Both were interested in eating and dining, but from a much broader perspective than the moralizing approach typical of so much of Roman dining literature.While approaches of this sort help to illuminate both the universality of the dining experience and its uniquely Roman aspects, the sharing of food also intersects in interesting ways with gender and the body. Matthew Roller, in his article "Horizontal Women: Posture and Sex in the Roman Convivium," examines literary texts, Roman urban funerary monuments, and Campanian wall painting in order to understand more completely the complexities of female posture at Roman convivia. On a historical level such evidence argues for women assuming a reclining posture; on an ideological level, the reclining woman symbolizes many of the same things that a reclining posture symbolizes for men—otium, privilege, and pleasure. Even so, the matter of female sexual propriety is never far below the surface, especially in the non-literary sources.John Donahue, in "Toward a Typology of Roman Public Feasting," examines public banqueting during the Principate against the background of modern typologies of commensality in order to understand not only the form but also the deeper social function of public dining. Donahue assembles a wide cross section of Roman testimonia and weaves them into a coherent (if imperfect) framework of festal typologies, while employing a cross-cultural and interdisciplinary approach, in this instance from French sociology. Argues for an objective protomoral normativity in terms of what an adaptation is for, without falling victim to Hume's Law, open-question arguments, queerness arguments, and internalism/externalism debates. Also provides a general strategy for naturalizing objective moral normativity which is likewise proof against the usual-suspect objections.

This paper develops a pragmatist approach to ethical business decision-making. It draws primarily on the work of John Dewey and applies his deliberative approach to ethics to the challenges of business practitioners. In particular the paper proposes the value of Dewey’s concept of dramatic rehearsal in emphasizing the task of “constructing the good” in ethical decision-making. The contribution of the paper is, first, to build on recent foundational work to bring American pragmatism into the mainstream business ethics literature; second, (...) to offer a perspective that is accessible to practitioners and integrates ethics into their daily tasks; and third, to identify a number of related research imperatives – in particular the importance of focusing efforts on gaining a deeper understanding of the deliberative process itself. Owens, John F It is about sixty years since Frederick Copleston was required by the ecclesiastical censor to insert 'some unambiguous condemnation of Nietzsche' into a new edition of his 'Friedrich Nietzsche, Philosopher of Culture.' Copleston thought the work 'disfigured' as a result, sensing perhaps that the addition would reinforce crude misunderstandings of his subject. He was aware of something that probably passed the ecclesiastical censor by, that whatever is to be said of Nietzsche's relation to Christianity, it is (...) not straightforward. (shrink)

Given an equal sex ratio at conception, the excess of human males at birth can only be explained by greater loss of females during pregnancy. It is proposed that the bias against females during human development is the result of a greater degree of genetic and metabolic “differentness” between female embryos and maternal tissues than for similarly aged males, and that successful implantation and placentation represents a threshold dichotomy, where the acceptance threshold shifts depending on maternal condition, especially stress. Right (...) and left ovaries are not equal, and neither are the eggs and follicular fluid that they produce, and it is further hypothesized that during times of stress, the implantation threshold is shifted sufficiently to favor survival of females, most likely those originating from the right ovary, and that this, rather than simply a greater loss of males, explains at least some of the variability in the human sex ratio at birth. The author presents and compares Maritain’s and Aquinas’s accounts of our discovery (1) of being as existing; and (2) of being as being (ens inquantum ens or the subject of metaphysics). He finds that especially in his final discussion of how one discovers being as being, Maritain’s account suffers greatly from the absence of any appeal to Aquinas’s negative judgment of separation and also from the omission of reference to the role of judgments of existence in one’s discovery of a (...) premetaphysical notion of being. Wippel finds no evidence in Aquinas’s texts for Maritain’s defense of an intuition of being or of existence. (shrink)
